seized upon tax day Wednesday to voice their concern over government spending and
debt. As the deadline to file income taxes drew near, about 300 people participated in the
"Cheyenne Tax Day Tea Party." Similar protests held around Wyoming and nationwide
the rebellion of the Boston Tea Party. Organizers said there were Protesters gathered
at the Wyoming Capitol to join other disgruntled Americans who Buffalo, Gillette,
Jackson, Cody, Green River and also rallies in Casper, Laramie.
A hearty group of about 300 protesters in Cody withstood blizzard conditions at times.
Gathered at the base of the Capitol steps, the Cheyenne protesters hoisted American
flags and handmade signs as they cheered on speakers. Signs on display read "Socialized
Health Care is Not Free," "No More Taxation with Lousy Representation," and
"Congress: The Opposite of Progress."
Along with criticizing government debt, the protesters railed against bailouts of private
banks and companies, the Federal Reserve System, spending on social programs and gun
control. "We're worried about the moral, political and economic direction of this country
today," said Kirk Kolkman, a telecommunications technician from Cheyenne who helped
organize the event. "We decided these events would be a forum to educate people on the
Constitution, nationalization of business and industry, and federal tax-and-spend policy."
Kolkman and other organizers said they held the event independently of any political
party or other group.
Duncan Philp, of Carpenter, said he was surprised at the size of the crowd Wednesday.
Philp carried a Gadsden flag -- reading "Don't Tread on Me" -- and dragged a United
Nations flag on the ground to display disrespect, he said. Philp said he's a member of the
Wyoming Tyranny Response Team, a group dedicated to the Bill of Rights. He said
Congress ignored Americans' request not to bail out financially troubled banks. "Bush
and Obama have done the same thing," Philp said. "They've given out loans for money
they don't have." "I just got fed up with the government and decided to get involved,"
said Pretty Martin, a Cheyenne resident who helped organize the rally. "Our
government is spending us into oblivion and taxing us to cover it."

Following the county officials was Duncan Philp of the Wyoming Tyranny Response
Team. Philp was on hand to show his support of the town in the open carry debate.
“I was absolutely flabbergasted by the notion that Pine Bluffs is some sort of gun-
grabbing municipality,” said Philp.
In recent weeks, town officials have been involved in a flap with the Wyoming Gun
Owners association due to the group’s perceived notion that town ordinances prohibit
the open carry of fire arms.
Philp took exception with the Wyoming Gun Owners response to the town and gave the
town some of his views on the organization.
“They don’t seem to have an inkling of how things are done,” Philp said referring to the
Wyoming Gun Owners Association.

The ATF is gunning for Rocky's Autos co-owner John Rothrock.

Holiday-season installments in the ever-popular series of late-night television
advertisements for Rocky's Autos have featured the Shagman character, costumed as a
pilgrim and chasing a turkey through rows of used cars with a blunderbuss musket in
hand. Given the pending federal firearms charges against Rocky's Autos co-owner John
Rothrock, arming the actor with a well-oiled submachine gun might have been more
appropriate. Jay Bevenour Rothrock, 34, is facing multiple felony counts for allegedly
possessing unregistered exotic weaponry and illegally converting semi-automatic rifles to
fully automatic machine guns. Though no charges have been filed, sources inside the U.S.
Attorney's Office in Denver say an indictment is imminent.
Rothrock and his attorney, Forest Lewis, both refused to comment for this story. But
friends of Rothrock's, including a Longmont gun dealer who has sold him weapons, say
the son of Rocky's Autos founder David Rothrock is under intense pressure from the
Bureau of Alcohol, Tobacco and Firearms to introduce undercover agents to local gun
dealers in exchange for protection from prosecution. They say Rothrock has so far
refused.
"John told me directly that the night they raided his house, [agent] Jerry Petrilli showed
John a list with the names of five gun dealers John had bought guns from, including
mine," says Bob Glass (founder of the TRT), a federally licensed gun dealer and
Libertarian Party activist who describes Rothrock as a good friend and a good customer.
"The BATF told John, 'You help us get these people, and we'll make this all go away. If
you don't, we're going to nail you,'" Glass adds. "And that threat was confirmed a few
weeks later when John and his attorney met with the BATF to ask what was going on.
The BATF told them they wanted John to go around and introduce some agents as
friends of his, and maybe in the future to secretly record some conversations, and John
told them, 'Hell no,' and walked out of the meeting. They've basically been holding these
charges over his head like the blade of a guillotine."

I have met O'Shea on two separate occasions: once when he arrested Duncan Philp, and
once when I appeared in court to testify regarding that arrest. (The case was settled
without me testifying.) Prior to my court appearance, I wrote some notes about the case
that are reproduced below.
On August 14, I witnessed the police arrest Duncan Philp. Duncan was sitting on a ledge
which was a few feet from the street -- the 16th Street Mall. Duncan was not making any
effort to pronounce his views publicly. He was not holding any type of sign or political
literature. He was not attempting to speak to other people. He was just sitting there. He
was wearing a T-shirt which read, "Tyranny Response Team." Pedestrians were passing
by only a couple feet from where Duncan was sitting. The bus was taking on and letting
off passengers a few feet from where Duncan was sitting. The police made no effort to
clear the area around Duncan of other pedestrians. Other civilians were allowed to roam
around the area freely.
Across the street, on the opposite corner, the police had set up a barricaded area called a
"free speech zone." The police had asked certain individuals to go to the "free speech
zone." The police did not require many pedestrians, including some involved in political
activity, to move into the "free speech zone." Officer O'Shea asked Duncan to move to
the "free speech zone." At this point, I was standing only a few feet from Duncan.
Officer O'Shea said that on the third time he asked Duncan to move to the "free speech
zone," and Duncan declined to do so, Duncan would be arrested. Then Officer O'Shea
cuffed Duncan and two other officers escorted him from the premises.
I then had a short and amiable conversation with officer O'Shea. I asked him why he was
moving some people into the "free speech zone," and he said he was only following
orders.
It is my opinion that Officer O'Shea gave Duncan an illegal order. It is my opinion that
Officer O'Shea violated Duncan's civil rights. It is my opinion that Officer O'Shea
discriminated against Duncan based on his political beliefs. It is my opinion that Officer
O'Shea violated the First and Fourth Amendments of the Bill of Rights as well as the
Fourteenth Amendment.

Or take a more current example, if you like. Recently, gun-rights activist Duncan Philp
settled a lawsuit against two of your officers for $20,000 -- an amazing sum for what
seems, at first glance, to be a case of a faulty traffic ticket. Philp was pulled over by a
Jeffco deputy last December on his way to a protest rally at the home of Columbine
parent Tom Mauser, who has become an outspoken advocate for tougher gun laws since
his son Daniel was killed in the school library by Harris and Dylan Klebold.
This was no random stop. Your deputies had Philp under surveillance that night and had
compiled an intelligence file on him, not unlike the Denver Police Department's notorious
"spy files." Philp beat the traffic ticket -- apparently, your deputies didn't know that a
motorist doesn't have to signal a turn when pulling out of a private parking lot -- and
then sued for alleged constitutional violations.
In a deposition, Don Estep, a member of Jeffco's intelligence unit and the FBI's multi-
agency terrorism task force for Colorado, made several damaging admissions. He
acknowledged that his unit had videotaped events the night of the protest but never
logged that tape into evidence; that Philp had been cited for not having a valid Colorado
driver's license when there was no proof that he was even a Colorado resident; and that
a Jeffco sergeant had obtained information about Philp from the state motor vehicle
database by telling a DMV official that Philp was under investigation for felony fraud,
when there was no such investigation.

Morrison, 44, is a Navy veteran and was, until recently, a custodian at Colorado State
University. He ran unsuccessfully for Angie Paccione's seat in the state legislature last
year as a self-proclaimed independent, pro-gun, anti-immigration, anti-abortion, born-
again Christian. An additional preoccupation, not listed in his campaign biography,
appears to be Duncan Philp.
Philp, a prominent gun-rights advocate who lives in Wyoming, posts frequently on
Tyranny Response Team (www.trtnational.com) and has been a fixture at antiwar and
Second Amendment rights rallies in Fort Collins. Morrison claims that Philp is a "hate
monger" and has shouted unpleasant things at him at protests through a megaphone. He
thinks he's seen Philp's car idling outside his home. When Morrison was banned from
posting on the TRT forum a few months ago, Philp suggested adding Morrison to a list of
deceased members: "Poor Darren we knew him well," he wrote. Morrison regarded the
jibe as a death threat.
Philp denies ever threatening Morrison. "I don't have the time to drive seventy miles to
stalk this guy," he says. "He was sending me all kinds of e-mails taunting me. We were
never friends. He found out that a lot of the Tyranny Response Team members are
anarchist libertarians, and he equates that with communists."
Last December as the feud heated up, a series of ominous e-mails went out to law
enforcement, a local gun group and others, ostensibly from Philp, boasting of his prowess
with a .50-caliber handgun. The most disturbing ones came to the inbox of Tom Mauser,
who's become an outspoken advocate of tougher gun laws since his son, Daniel, was slain
in the 1999 attack on Columbine High School. Philp was involved in a protest outside
Mauser's home in 2001 and collected $20,000 in a lawsuit over police harassment
stemming from the incident ("Deeper Into Columbine," October 31, 2002).
"I have a laser site on my 50 cal as well as a home made silencer," one typo-riddled
missive read. "I have spotted planes fling into DIA. I could easly shoot one down so do
not take any trips for a while."
